Competitive flexible procedure description

This procurement is being conducted under the Procurement Act 2023, using a two-stage Competitive Flexible Procedure.

The process is structured into two stages:

Stage 1 – Procurement Specific Questionnaire (PSQ) Suppliers are assessed against the Council’s conditions of participation, covering legal, financial and technical capability. This stage includes pass/fail checks and scored specialist knowledge questions. PSQs will then be evaluated by the Council to determine which organisations will be shortlisted and invited through to the second stage.

Suppliers must obtain a “pass” for each of the questions/sections where it is stated as being a pass or fail assessment. The Suppliers that do so may continue to take part in the procurement process. If you fail any of these questions, you will be excluded from the competition and not invited to Stage 2 of the tender process.

Questions numbered 2; 5 to 6; 8 to 13; 15 to 21 are mandatory questions and will be assessed PASS or FAIL. If you fail any of these questions, you will be excluded from the competition and not invited to Stage 2 of the tender process.

Questions numbered 22 and 23 are mandatory questions about risk management and your experience. Your response must achieve a minimum score of 3 in each question and will be scored based on the criteria set out at 7.5 below. The Council will reject any Tender that fails to achieve this minimum threshold score in both scored questions, and you will not be invited to submit the Stage 2 method statements, social value KPIs and pricing documents.

Interested organisations should complete and submit the PSQ during the first stage only and await the Council’s evaluation and shortlist before continuing.

The Council will notify unsuccessful bidders who will not be invited to the second stage and the successful bidders who will be invited to the second stage of the procurement.

The five highest scoring suppliers will be shortlisted and invited to participate in the next stage of the procurement process. Where two or more suppliers achieve an equal score in fifth position, all such tied suppliers will be shortlisted. Supplier ranking is determined solely by final weighted PSQ evaluation scores.

The scored questions in the PSQ are questions 22 and 23, the maximum score for each question is 5, the total combined score therefore for the two questions is 10. The questions both carry an equal weighting. The minimum score for each question is 3. If you do not meet the minimum score, you will fail the question and will not advance to Stage 2.

Stage 2 – Invitation to Tender (ITT) The shortlisted Suppliers following the PSQ stage who meet the conditions of participation will be invited to submit a full tender. The ITT will be evaluated against the published Award Criteria (Quality, Price and Social Value) to determine the Most Advantageous Tender. Progression to Stage 2 confirms eligibility to tender and does not guarantee contract award.
